Recd the CPO E mail today @ 7 PM EDT - 9/15 from TSC
EB2- June 04
Attorney Sent a Letter to AILA liason on 8/20
Called TSC on 8/27/ - Opened a SR
Called TSC again on 9/3 - CSR told me that they sent a reply for the SR opened on 8/27
Recd the SR - reply on 9/4/09 stating that " your Application processing is pending/delayed"
Called Senator office on 9/9/09 and sent fax
Called Senator office on 9/14/09 - Liason officer told me that it will take 30 to 60 days to get the response.
Called other Senator office on 9/14/09 , Sent the fax
Called again to II Senator office on 9/15/09, I was told to call back after 15 days to get the respose
Called TSC again on 9/15/09 around 4.45 PM EDT, Talked CSR , So nice , she eve discussed about the weather , summer time events etc, I told her about the letter I have recd for my SR ( 8/29), she asked if it mentioned any time frame, And i told her "No", then she said it is very unusaul and tranferred my call to the officer,
1st he told me the current processing time is 9/07/07 and my ND is 9/28/07 so my application has a 21 days lag, Then I told him that my application has mailed on 8/7/09, I also mentioned about the letter i received for SR, then he started asking questions about the receipt # and case details
The the officer verified following details
My first name,
Last name,
Address, Zip code, Door #,
fathers first name
mothers first name,
4 Digit SSN
and then told me that your case is under review with an officer from 8/29/08( Then I realized both of us had a Soft LUD on our application on 8/29/08) , I told him about that, the he said yes it is , it is related to the interal process. Then I asked him that What can i do now, He said, Keep your faith and finger crossed asked to me keep on calling USCIS TSC office every week to check about my case.
I really don't know whether he is playing with me or what.

once significant amount of AOS applns were received - there will be a process to dispatch these rejected applications base don priority date.

I saw somewhere on other site clearly mentioned that once 485 is rejected, H1B extension based on pending 485 also becomes invalid. If a person keeps working, it it considered as illegal. I do not have link right now, but I guess I found it on some lawyers website, posted link on IV in some other thread.

I wont get into EB2/EB3 fights, but tell you what my opinion about this is.
The law definitely supports interfiling and priority date porting. However, this is like reserving seats on a bus by throwing your handkerchief in good old India. It is unfair to let people jump ahead in the queue, even though they acquired the eligibility to file in EB2, at a far later date.
There might be some genuine cases where people could not file in EB2, even though they were eligible. I only support these cases.
I've a pending EB2 485. However, let me be honest. If I had EB3 to start with, I too would've interfiled in EB2 and would've ported my priority date. Who wouldn't do it if the law allowed them to!

immigrationportal has reported only 2 cases of rejection for july 2nd filer. Their package returned back and received by party(around july 10th), per forum there.

From Greg's yesterday's latest response that there were very few which were returned/rejected on July 2nd itself and this thread proves that we are not alone ...there are so many and status is unknown. Matthew Oh is also suggesting that it will be receipted. I think we are all safe and with time we will get receipt. Nobody...none of the attorney's are suggesting refiling. Now the thought that whether my packet was properly filed or not? I think that will always be there in the back of one's mind but if the attorney has done his/her job correctly I think we should not worry. Its not rocket science and documents required for filing are well known...so I would discount this risk. It appears we are all safe because as we all know that no rejection notices have been generated, packets if returned should have come back by now as per Greg....All in all it all points towards our packets being on hold there at respective centers....but as you rightly pointed out..towards the last week of July keep calling centers to know..but even before that keep eye on check clearing as that by far is the best and earliest clue that all is well with the case.

Have decided to dump my H1 for good and start EAD on my new AC21 job soon.
getting job on EAD is much easier than h1b sponrsorship. AC-21 law was created to protect employee because of processing time taken by INS at that time.
At that time, USCIS ( former INS ) was taking probably more than 1 year.
By law, you can safely jump on 181 days and a lot of people are thinking of that for whatever reason. But my take will be that you should not jump on new job if
- If you are relatively stable in ur job and compensated ok.
- ur PD is very old (2001-02) because you case may be close to adjustication.
- You may have greater challange keeping ur new job if economy went south
if you get laid off from a job then it is much better to get a job on EAD rather than H1b. Probably underlying intention was AC-21 to protect alien in case he gets laid off. I know a lot of people take taken advantage of AC-21 and it is good.
BUT final regulation has not been published and USCIS final rule of AC-21 may be severely restircted in final rule (especially with July VB fiasco)

How many core IV members have already received their GCs besides Aman, just curious?
Of late is there anything of note even happening on the lobbying front? IV seems to have become another Immigration Portal kinda website where people are now posting all sorts of info, some of it not even immigration related.
It would be nice if someone in the core team updated the rest of us, who cannot join the state chapters due to personal reasons on the website.

Periodically communicating with members stuck in green card backlog in your community/state takes just couple of minutes in a week and is not demanding at all. This channel takes extremely less time to update yourself with what is going on. So that is the channel we are following at this time to share information. As such we request you to please join the group/team in your local area and use that channel to get the updates. When there is an update that can be shared on the forum, we do post the update for all the members.
I received my green card in June-07 and shared this information on the forum earlier. There is one other member who received green card in past few months but for the purpose of privacy it is better for the member to have the choice if/when to announce on forum. I hope you understand and appreciate if someone decides not to announce a specific personal information on the public forum. No other member of core team have received their green card and regardless of the fact whether we have received the green card or not, we continue to do everything possible to work on fixing EB green card delays/backlogs.
