    I totally agree with the reasoning logiclife presented.

    Its very important that we (legal immigrants - especially work based GC applicants) take this cause seriously with some action or contributions. Following points have convinced me more:

    1. Large IT companies have acted dissapointingly as far as our cause goes. They are ready to pay $85 or $100 or more for us as consultants but wont take up our cause. Most have increasingly decided to hire H1s as consultants rather than hiring H1s directly and even when they do hire H1s they are reluctant to file green cards. Some will file green cards just to keep us hooked - but wont petition on our behalf to make the process more efficient. IT companies used to be our biggest supporters - which we seem to be loosing as time goes by. (There are a few exceptions of course - not all companies are just happy to exploit us and not help us).

    2. Since the terrorist attacks most states and cities along with the federal government have systematically erroded privileges (sometimes even basic privileges) granted to legal immigrants. They have been successful since the mentality of the nation has turned negative towards new immigrants. Of course this has been done very efficiently in sublimal ways by mounting hurdles for us. One stark example - Drivers licenses for immigrants can only be issued in some states at few select DMV (or BMV) locations (hidden behind a logic that not all BMV centers are well equipped to handle the security checks now required to be conducted on immigrants before granting IDs). This is ridiculous - we are expected to work but it will be increasingly difficult to do what we are expected to (privlege to drive is an example).

    I am sure folks can add more points. These points make me feel as if our cause is not worth worrying about for even fair minded residents - we are a forgotten lot. Therefore, we must raise our voice.

    As I thought about this further, I figured out the data is even worse than I thought earlier, as this may not have any 2007 numbers. People who filed their labors in 2007 were still waiting in july of 2007. So this data is only upto late 2006. Now the figures could be

    Guys there is no doubts if you have an opportunity like where employer is paying for the Green card process, I guess everybody should get out of the EB-3 mess. If you stay in EB3-I then you are the last one to get the VISA. If you port it to EB2-I then you put EB3-ROW behind and you get in line first in EB2-I bcoz you will have older PD.

    Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.

    But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.

    It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.

    I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.

    Is there anyone else in the same boat? How long does it take for MTR to get processed?

    I don't care when i would get the Green card. what i want is interim relief (AP and EAD). Something is better than Nothing.

    Can your spouse work? ...yes
    What will be her status if she uses EAD?.... GRAY area no one knows
    What if you get GC first and some problem with your wifes petition?....Gray area no one knows
    What if your wife is on F1 (got EAD and AP) and she graduates waiting for a long time for GC ..can she jump to another status ...Gray area..If yes any problem with her status...no one knows
    Can you start business on EAD...GRAY area no one knows

    Do you think they will allow you to travel on H1 all the time if you have AP... for some luck ones yes but for some others nope...they are forced to use AP..

    Its much horrible after getting EAD and AP and waiting....

    Well you will realize " Nothing is better than nonsense...interim state"

    Its good to have EAD and AP but its not worth waiting for so long after you get them.

    We were successful in bring in some change...why don't we work a little bit more to fix the system and get the GC faster..

    "Jab Loha garam hein..tabhi kuch karneka hein...whatever...

    All i want to state is lets continue...and dont give up until tere is improvement with the GC

    Well, you did not give your easy example, nothing about affirmative action, nothing about representation or overwhelmed by Indian and Chinese thing, and absolutely nothing about preferential treatment. So in-effect, you totally skipped the entire debate, I guess my trick played well, you are now overwhelmed by Frank Caliendo, just as you are overwhelmed by Indian or Chinese.

    And while you "hinted" that we are all equals, you did not say - if we are all equals, then why should there be PREFERENTIAL TREATMENT for one group of people over others, unless someone is still practicing APARTHEID. Last time I checked, practicing apartheid is a crime in US and it can land you in jail, not sure if you knew that.

    And while you continue to apply for your green card, you are still charging "India" for that because as per you, your country of charge-ability is India, right? If you are actually from India, have you ever heard of Ron Hira. If not, check it out, you will know who he is. You are Ron Hira of country limits, if you know what that means.

    Sanju, I did not promise to give you any more examples - easy or otherwise. People have made up their minds, and arguments against the stand devolves into character assassination. While I myself dont care about the dots, and seeing that the discussion started off, at least in part, about unscrupulous distribution of dots, I find it very ironic that I am getting insulting words thrown at me. Either these people cant understand irony, or they really are just learned "angootha-chap", or they are addicted to red-doting people (pretty much bringing the prophecy of the original poster true).

    Ron Hira? I dont know much about him, just saw that he wrote a book about outsourcing, am I Ron Hira of per country limits? maybe I am. But, you assumed that I like the per country limits. I hate a lot of things but I live with it. There are lot of things that we hate but are there to help regulate the environment (among others).

    The point I am trying to make is that such an action will not be "fair" to people who are in queue (who rely on the 7% cutoff to get their GCs). If the congress makes changes to the rule, then people will have to live with it (fair or otherwise)... by the way, most rules are not made to be fair to everyone. But the thing is such action will have a negative impact on ROW, and it is a pity that many ROW dont realize it. They seem to blindly following IVs call of action. There is some saying about blind faith that escapes me at the moment, but the bottom line is that blind faith is a dangerous thing.

    So am I escaping form expounding on my thoughts. Yes, and No. I think I have made succinct argument (based on the laws) as to why things are as such, so I dont see the need to argue further.

    Why are you consuming and wasting couple of visa numbers. Pull back your application and I will be couple of hours early getting it.

    GC should be received by people who need it desparately not to people like you who just want to get it for personal satisfaction and has no value for it.

    I am writing to you to express my sense of helplessness over the unpredictability of Visa Number allotment to various employment based category. I want to bring to your attention that it�s been nearly a �Decade� since we saw any meaningful Visa Date movement from year 2001 for EB-3 Green Card applicants from India.

    It is important to know that despite of severe visa retrogression and random visa cutoff date movements, USICIS or DOS hasn�t released any official information on how many Adjustment of Status applications are pending at USCIS under various categories which leaves thousands of AOS(Adjustment of Status) applicants in complete darkness and dependent on guessing games by various Law firms.

    A green card application requires enormous amount of efforts and money from the beneficiary and his/her employer. People who are waiting for 7-8 years now would have had already spent average $15,000-$20,000, in maintaining their statuses and keep the Green Card process going on. Being stuck in a green card process keeps us bonded with 1 employer, job type etc.
    We need to know if there is any light at the end of the tunnel. We need to know for how long we have to live our life in limbo. If there is hope than we need to be patient and plan to live like that for another 1-2 years. But if there�s no light at the end of the tunnel than we need to move on with our careers and other family commitments. Only your office and USCIS can help us by releasing statistics on the number and categories of applications pending with USCIS people waiting in this category can plan their lives accordingly.

    It will be a great help if DOS or USCIS could tell us about the number of AOS application pending at USCIS along with their Categories(EB-3, EB-2, EB-1) and chargeable country.
    We have been waiting for a decade and continue to wait would it be reasonable to request you for some guidance with regards to the Visa allotment. I request your office to provide some statistics on home many Adjustment of Status applications are pending at USCIS.



    We understand that you work with in the limits of the law as set by the Congress and are limited by various constraints that are beyond your agency realm of work. We appreciate your hard work and sincerely thank you for all the hard work.

    Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

Just be happy for it...its just your need so that you can live in this country for as many year as you want and of course its good achievement and i am happy for you, you just lived here for 10+ yrs and you forgot your Home country where you were born and gave you a good education with you had an opportunity to come here and make your life based on that..you should be PROUD of that country no matter where you go and what you achieve its all because of you Home Country
