    I am a LEGAL immigrant how has waited in the line for Green Card for 10 years. I've paid my taxes, social security, medicare and followed the law. Immigration bureaucracy and inefficiency at USCIS has meant more than 250K of Green Cards within legal limits have gone waste leading to a very long wait for legal immigrants.
    Please tell me what I should do - Wait another 10 years? Go back to home country? or jump the fence?

    Guys I added one more question, a little succinct. Please vote for this along with others hopefully one of these will be picked. Thanks

    No, I'm not being facetious :)

    There is always a chance that a well publicized (we are working on that part!) rally might attract opposition to the rally.

    I wholeheartedly think that this gesture would be seen as fairly "american" and could defuse tension if it arises. Plus it would link back nicely to the flower campaign as well, and the eventual destination of the bouquets sent.

    Political stance on wars aside, I don't think there are many people who don't support the lives on the line.

    gimmi green - Don't you see green around you. Let me tell you how to get green

    1) Use your credit history to purchase additional home in Florida. House purchase in 150000 will be 250000 in year. The market was like that a year back. It takes 8 months to get a house. There is a big line.

    2) Open your own e-business. File E visa. 1/4 million should be easy money if you have stayed here for 10 years.

    3) House listing in only done by realtor. Give option to customer. For fun open a site for people to list their house for sale. Give them free service then charge. Live American way.

    4) Make school in Village. I have made one. I enjoy supporting the school. Grow India.

    5) Don't worry about GC. Do something. Registering a site takes some $35 or 40. Built you site. Use American brain.

    Am I doing it? Yes.. Did I make money? Yes.

    The current housing market condition are totally opposite to what you say about housing markets, especially in states like Florida, California etc. American economy is slowing because of cooling ( eventual bubble burst?) in the housing markets and because of high inflationery pressure. Most economists agree with this view only people still propogating the myth of house ownership as an investment are Realtors and "Flippers" looking to unload their houses on ignorant suckers. People made money, yes, but that was upto mid that is when housing market peaked. It has been on sequential monthly decline since than. Buying house as an investment in current economic conditions is bad advise. Save money and wait till late 2007 or early 2008.

    Same thing applies to US congress. They dont set their timetable of bills based on morality and merits. There are other factors.

    Like it or not i am becoming a big fan of your posts. There is more logic to your life than ppl who question you and ur Core Team's Selfless efforts.

    Lot of ppl do overlook that this is a grassroots organization with severe limitations. Those who sling mud at these ppl, If you cant appreciate what the core does, pls dont curse them. It is not for your or our Good.

    My only worry is that these CORE members get discouraged with numerous flaming posts and drop out of this noble cause.
    If that happens there will be nobody to work for us. :(

    How do I find out if there has been a Soft LUD? I have an online account on uscis.gov and the "Last Updated" fields are all in 2007 (when I filed my AOS).

    Can't we turn Mr Durbin to our side since IL has a large Indian community ?

    Define which Indian community?
    Gujratis who own motels and shops and will want more family immigration vs H1B

    or

    Indians who are now citizens. They will want less Indians to reduce competition for their jobs or for their children.

    or

    Desi consulting owners : less said the better

    or
    Desi H1b, students EAD etc...
    They are a scared lot anyways and only worry about their immigration status and making dollars. Go tell them about IV if you can?

    So tell which Indian community you are talking about?

    Good idea. I start with my contribution of 25 dollars(sending check today through Bill pay) in addition to 150 that I have made before.

    PS: Wish I could contribute more.

    How about this - let us have a couple of volunteers call/email people asking for $25 contribution. If we can get 1/2 of 3000 people contributing $25 each, we will get to about 120K. I am ready to take initiative in this - core group, can I get this initiative going?

    I agree, there is slim chance that 5882 could pass, we must do our best and not let it slip out of our hands. Keep writing and calling. At this rate EB 3 I will not move more than a couple of months per year. The new visa allocation policy will retrogress EB3 ROW too and as EB3 ROW starts getting retrogressed there will be less and less available for EB3 I.

    If you can porting to EB2 is always a better choice.
    For EB3-I's with PD > 2005 it is worth the risk even with the gray area that USCIS may not accept the porting. An EB2 I PD of 2008/9 will always be better than EB3 I PD > 2005.

    HR 5882 is the only solution for all atleast for this year.

    I am not sure if that is going to be an advantage since my PD was not current in JUNE

    who knows? immigrantconnect.com reported that they heard that some applications were approved in june even when the pd wasn't current in that month. i wouldn't worry about it.

    Memos are for interpretation of laws by USCIS. Any memo is advisory in nature and does not have force of law. These memos, unless challenged and turned downed by court or withdrawn, are valid.

    Your saying that memo is illegal does not mean anything more than your personal opinion.

    H-1B petitions have denied in past based on employer-employee relationship, unable to specify duties at end client, and self employment cases. If you are interested, let me know, I will put links here.

    PS: This does not mean that I personally agree/disagree with the memo. This is just to show the legal aspect of it.

    I know what you are referring to. USCIS has tried to raise this issue in the past in 2 instances. Once in 1990s and another in 2006 timeframe. In both cases lawyers were able to force USCIS to back down. Lot of consulting company applications have been approved since then.

    The only difference this time is, it has come in the form of a memo. It is in fact a blessing in disguise. AILA has some reference document against which they can fight in court and get it overturned permanently.

    Legacy INS (now USCIS) raised many similar issues, in the early- to mid-1990s, regarding the length and nature of the projects in the U.S., timetable of assignments, and the H1B employer’s ability to pay the required prevailing wage. Senior Legacy INS officials from headquarters in Washington DC addressed the concerns of those examiners by pointing out that the law does not permit them to investigate a U.S. employer’s ability to hire H1B employees. The USCIS is bound by memos and policy guidance of the Legacy INS. After that memo, Legacy INS stopped issuing lengthy RFEs on these matters.
    The law does not require any such letters by end-user clients for the issuance of the H1B visas to the visa applicants.

    Dear Friends,

    Got Green cards and Welcome notices for me and my wife .
    Surprisingly no uscis e-mail and online status is still "initial review"

    Our journey in short :

    How long in US : 10+ years

    First Labor in 2002 . Changed job in three years before approval of labor
    Second Labor in 2004 . Approved in 2007
    Filed I140 and 485 - in July 2007

    Since then I was enjoying EAD / AP with no complain .

    I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
    From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
    My Lawyer told me that I can port to EB2 and it is a normal a process.

    1. New Perm
    Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )

    2. EB2 I140 (TSC)
    a. Filed in March - Premium Processing
    b. My Lawyer sent interfiling letter along with I140 filing
    c. Approved in 7 days (A# and Priority Date retained)
    d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
    e. No email and no updates on USCIS website

    Not sure about the USCIS and Lawyer fees . My company paid for every thing.
    Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

    But the cost of collecting 5 bucks a month from 20,000 members makes this less than desirable. An yearly $60-100 membership fees is what I'd expect to pay to any organization - more if that organization is actually working to make a significant difference to my life, to resolve issues that affect me more most other stuff.

    A 2-month trial-membership is more like what a business does... and may not be desirable for all the house-keeping involved in such efforts. For subscription-based content websites, this may be O.K. - but that's exactly what we're not, and shouldn't be perceived as such.

    I would suggest giving a 2 months trial membership during which the candidate can examine the benefits of IV. After the trail period, charge a nominal $5 monthly fee. I think that should be very reasonable, and nobody would lose their sleep over parting with $5. That would easily raise about $100K per month (~20K members*$5).
    However we should continue to encourage members to commit to monthly contributions if they choose to voluntarily. Also as someone suggested, different access privelages may be assigned.

    Not being judgmental at all. This is a question that has to be posed to the HR department in the company and not to 'peers' on a forum. The profile says he/she is on EB2 and then he/she goes on to ask this

    "let me know if they have done EB2 with this scenario." WTF! :D While I'm not against getting your degree online or IGNOU but you need to at least have the acumen to geo-locate yourself it nothing else :D Other skills are far superlative and come much later :D

    I think we as high skilled immigration community need to accept some sort of restrictions on H-1B visa for our provisions for lost visa recapture or additional EB permanent visas. We need to let Senator Grassley know what we can accept. Otherwise everybody is at standstill and nothing will happen.
