I dont think it's a good idea. The fundraising thread demonstrates that we do have people who understand the stakes and are willing to do something about it. Ofcourse we need a lot more money but we should be able to persuade people to contribute voluntarily. I don't like exclusive clubs

Nice. It appears that according to the link below:
http://immigration-information.com/forums/showpost.php?p=18946&postcount=28
The EAD doesn't get invalid when AOS is denied and will be valid till its expiration date.
On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.
Thoughts?
Did I understand wrong?
After 6 yrs on H1 with pending AOS, if 485 gets denied, H1 is not renewd. So far so good....
I am under impression that aftet the denial, person still has whatever time left on his H1 to stay and work till H1 expires. No futher extension will be possible due to denial.
Is above statement wrong????
I had checked with my attorney, he had mentioned that I could keep on working till my H1 expired.... I will recheck with him.
Regards.

Sometimes, the fears arise from watching too many movies. Like the movie "Enemy of the State" where some govt agencies hunt down Will Smith and unravel his life apart. Remember? Gene Hackman : "US Govt has computers underground that are several square miles and they track every wire, every airwave....".
What a bunch of ****.
Firstly, its a movie. Secondly even if its true, what's there to be afraid of??? If you talk on the phone about legal course of action to lobby, why would you be afraid of.
Like I said, you have to give some credit to the Irish. They have the chutzpah of going to lawmaker's offices in DC and say "I am an illegal...I broke the laws and overstayed my visa...please change to law to make everything ok again for me please...". And our community thinks that someone is listening to their phone conversation about how to raise money and lobby for the legal immigrants?????
There is a big difference when you are Irish and can blend with the americans.
Peolpe from other places might raise suspicion and be detained.

Ramba,
Yes there is demand, but that demand initially came from NRI's. This is when properties were worth under 20 lakhs. But soon the prices jumped to levels even unaffordable to NRIs. Now these prices are unsustainable because even a person earning 1 lakh per month cannot afford a 50 Lakh worth propery. This is because of high interest rates on home loans.
I know few real estate houses where they are almost close to bankruptcy because they couldn't sell the houses or land. They borrowed huge amount of high interest short term loans and now can't sell the properties.
Sure, there is demand but economics will take the front seat at the time of materialization of this demand.
Your theory sounds exactly that of my father. When i challenged him in year 2005 that property values in Hyderabad will have to fall as the rise in prices is riduculous, he laughed at me. He said "I have not seen in my entire life a price drop in property prices". When i said, i will not invest in real estate until the prices fall, he just made fun of me.
I was at the receiving end for the past 2 years both in US and also in India for the decision not to invest in real estate here and also in India.
Luckily the piece of land i bought in India in the year 2004 still holds its value.

There is vast difference between US and Indian housing market crash. India RE market will not collapse like here. There may be a melt down or small correction. The simple big reason is demand for housing in middle class due to economic growth. Based on population density, US is 9 times bigger than India. Lot of land in US. But housing land is so limited in India. So there is always demand. Second reason, there is no sub-prime lending in India. Third, in India, housing loan is based on cash worthiness rather than credit worthyness like in US. So we may not see such a massive foreclosure/bankrupcy in India to bring the price down considerably like in US.
However, now the prices or extremly high, such that it can not be affordabe to people other than NRI or IT folks. 1 crore houses are very common now. Based on US economy it will definitly come down. It will be depend on how hard IT/outsourcing bussiness gets affectd in future.

Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)
Cheers,
h1techSlave
I hope I am totally wrong , but if USCIS has decided to put July 2nd applications in COLD STORAGE , then July 2nd filers are in for a long & bumpy ride.I hope we don't become the rolling stone in the game between AILA & USCIS.
What a shame? For hiding their own shortcomings , they are playing such horrible games with our future.
Peace.

Now thats a relief for all of us!
I do have this question:
How long does it take if I get my GC now (as a bachelor) and then later on apply GC for my wife? I heard its around 4-5 years again?
So, would it be a better decision to wait and not apply for 485 (I have my 140 approved as of Dec 06) now until I get married to be able to apply it together with my wife?
Comments/opinions please!
Thanks!

Anybody has this situation?
My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.
As per USPS online tracking record it was delivered July 2nd 12.45 PM.
No receipt yet. So far sounds okay.
But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.
It is a stamp so some of their employee clearly has stamped it.
Now I am confused if that’s the receipt date they are going to go with and may reject the application.
And with this many application it may take more than AUG 17th to receive anything back.
I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.
And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.
Anybody in the same situation? Any advice?
Thanks

You do NOT have to go anywhere - what you are saying is "SBI Rapid Remittance" by SBI where the money will reach your Foreign account the very next day ( But you might have to wire the money as well to BOA-NY or SBI-NY ?)
www.onlinesbi.com/rr - This is SBI's response to rapid exchange.
What i'm talking is "SBI Direct Remit" & takes 3-4 business days but just click of computer mouse once you are set up. I actually set it up Monday morning EST and Friday Morning EST i see my money at Foreign account. No need to open a account at SBI-NY or anywhere but its good to have the target account at SBI ( it can be your mom/dad's SBI a/c or yours , doesn't matter really )
www.onlinesbi.com/glsus
Is there anyway that we can open a account with SBI in India from here(US) for ourselves and then use this method to transfer funds into that account.
Has anybody done that..
I would appreciate it if someone can let me know if this is possible ,pros&cons in this if any.
Thank you.

In the US for 11 years now. - 7th year H1B
Thanks for starting this topic!!! This could be an emotional thread for a lot of us who are still waiting for this rediculously long process of GC!!!!
More frustrating when:
Waited for 3++ yrs for the labor cert (PD Sept 2002)
Just submitted I140 (6/2006) but have to endure the fear that my EB2 will be kicked to EB3, which means RETROGRESSION!
With H4, wife cannot work. Going to school is too expensive..i can't afford it with my small salary
Stucked with current company...being under appreciated and under utilized by the current employer...not a place for me to build my CAREER!!!
Have potential contract jobs/independent consultant positions available (recruiters contacted me) which pay 50% than what i am making now...but can't accept those offers bcos of GC!!!!
So so tempted to return home for good (sick and tired of the WAIT), but Everyone was saying "u had waited for years now, so why not wait for another year or so to get it..don't waste the golden opportunity" But...but...is it really going to be just another YEAR?
Sigh...sorry for venting...but i am really upset!
Going back to Career options...
**yeah, i would like to get a PMP cert, but it is pretty EXPENSIVE. But maybe some of us who done that can advice me.
**About buying houses....really clueless about it...really scare i will get ripped off by people..any advice?
** Yes..i want to know more about E-Visa and making $$ via online business!
Thanks all....
Sky
Look at my case.
1) EB3 PD March 2002. After more than 4 years I got my Labor.
2) Filed for I-140 . Cannot file 485 now.
3) H1B 9th year going on.
One good thing I did ,I bought a house in Dec 2002.Now If I sell the same house,I will get minimum 100K profit. I will get good appreciation now.I recommend you guys to buy a house now. It is the best time to buy a house, because it is "Buyers market" now ! You can make some money if you sell it later...

I didn't find where in the PDF AILA is saying the definition is illegal!
They provide one example a court ruling where the EE definition was established in the case of an insurance agent. But such an issue has already been address by the EE memo by USCIS (Temporary/Occasional Off-Site Employment).
Is it your own interpretation that the EE definition in the memo is illegal or did you read it somewhere in AILA's response?
AILA Memo (http://www.laborimmigration.com/wp-content/uploads/2010/01/AILA-Memo-Seeking-Revokation-of-Neufeld-Memorandum.pdf)
Page 3
The AAOs analysis contained in non-precedent decisions but cited repeatedly by adjudicators to justify RFEs, NOIDs and Denials -- and now expressed in the AFM revisions regarding H-1B petitions -- begins with the proposition that the beneficiary in any employment-based nonimmigrant or immigrant petition must be an employee of the petitioning employer. The AAO then notes that the term employee is not clearly defined anywhere in the INA and concludes that absent such a definition, under Darden and Clackamas, it must look to the common law definition of employee to determine who is and is not eligible for employment-based benefits under the INA.2 While the common law definition employs a multi-factor test, the AAO and subsequent adjudications, and the Neufeld Memorandum, have focused almost exclusively on one element: control.
AILA memo deals with multiple issues in the memo, not just consulting company scenario. (L1, Self sponsoring employee etc) Hence we can get lost while reading the memo. Central to the argument is "Common Law" that AILA hasn't gone in depth.
desi3933,
Please refer AILA memo (http://www.laborimmigration.com/wp-content/uploads/2010/01/AILA-Memo-Seeking-Revokation-of-Neufeld-Memorandum.pdf) as they have already detailed the law points in it.
Also you seem to be quoting USCIS documents. If USCIS was clear about the law, they wouldn't have issued this memo in the first place. If USCIS memo contradicts INA, INA prevails.

Hello:
The company I am working with doing business for 40 years (less than 40 employee) and as per my lawyer, financially very good. I hired the lawyer and employer directly gave him financial docs. I am only one person with H-1 in this company's history and working for 4 years. Got labor approval on PERM EB2 (MS+1) and did concurrent filing with I-140 premium processing.
I received RFE regarding company's ability to pay. We sent tax files for FY 2005 (contains oct '05 to Oct '06) for being PD of Nov '06 and W2 for 2006 which showed 6k more than offered wage. Company started paying me offered wage one week after the PD and offered wage is 3k more than prevailing wage. RFE specified to show ability to pay by showing 2006 tax return or audited financial statement by 12 weeks. Any of this will not work as tax file will be prepred on Nov '07 for FY 2006 and audited finan. stat. costs a lot of money. My company has no clue and just planning to write a letter that they will not able to provide before Nov 07 and already submitted tax file upto Oct 06 which could be enough to find the financial status. They talk to their CPA and he advised to do so.
I am really not very fimilar with all these issues. What should I do as company is not able to provide above 2 things that USCIS asked for? Can I send my paychecks even started getting paid offered wage after one week?
Appreciate you feedback. Thanks,
Is your salary higher than offered wages since PD month-wise? There could be a way out.
Not a legal advice.

Congrats Man, all the best for your future, I have yet to apply for GC (i am in my 4th year of H1 B, my company said they would take care of it, and they are painfully slow, i have now been here for 7+ yrs).
Immigration is personal choice in my opinion, i am sure it makes sense to say i am proud of my heritage/culture, but like everybody else i came here for a better life.
The wait for GC is very very frustrating, other the other hand it is absolutely unnecessary if the Immigration authorities just put a little effort and time into resolving it, I guess that is a underlying statement about skilled Immigrants, you have to go through a lot of frustration, pain, and anxiety to be worthy of a GC. I am beginning to wonder, if all the energy (positive and negative) i am spending here to get my GC could be spent more efficiently and in a calculated manner in India ()
I am from India, I hate corruption and bureaucracy prevalent out there, I came here for a life filled with fun and freedom(what i thought was a better life :(), i still would like to have GC, but the wait, the tension that i need to take out here, is pushing me back to thinking maybe coming here was not a good choice in the first place, my Family is in India, and a couple of my friends are still around in India , so hopefully, when i DO go back i can hang around them and have FUN.
As one of the members said, you cannot take India out of a man, why ?, because we have 5000+ yrs of glorious documented history, a wonderful ,colorful culture, and is the home of great people, that's why !, and that culture is entrenched in our psyche. The generation of kids born to indians here is US wont/cannot/ relate to that psyche, people like us export India, but for the next generation India ceases to exist, just my 1 cent.
Sorry if i bored you folks with rants and raves cheers !!!

@krishmunn thanks for your analysis too , i had sent him a bunch of emails about 10 of them and he never responded to them, when i called him about why is he not replying to my emails he said i cannot have any email conversation with you, it did not strike me then why ? but after talking to all the guys here i understand why he said so, i do not know if this would be enough . but i am just preparing my packet to send to DOL
@PrinceVA i really appreciate your help and your kindness at least someone in the fraternity doesn't believe in finding the nationality before helping. Well i really appreciate your concern and i wish that you were a part of my employers team, but i have my tickets booked and bags packed . I would now empower people from all over the world to come a little more prepared on H1B to US. I admit to being dumb before landing here but i have gotten my much important experience which i will pass on through fake busting.
@apaul thanks for your analysis paul it helps me understading the situation even more.
to all the others, i will be going home soon and i shall disclose the name of employer here once i get an ack from the DOL. I appreciate everyone here and their help.
Thanks to all those who have given me intelligent advise
Next time someone says they cannot reply to your emails...record the phone conversation :)
Unfortunately there will be others who will also make these mistakes....but tell us who the company is and spread awareness in the area you come from...so maybe others can be spared

The thing is I am sure most people here will not have a problem with paying the new higher fees. Infact it might turn out to be cheaper in the long run, cause as I understand it the new fee structure has the EAD and AP fees built in for a one time payment instead of yearly renewals. Like I said this is my understanding.
If this is the case we will be better off with new fees, cause even if they do decide to accept the 485's there is no way the approvals are coming anytime in the near future. I am sure if they do accept the 485's the dates will retrogress to the stone ages. So we can avail free renewals of EAD's and AP's till then.
But when i think about this again, If they do decide to go charge the new fees for all applications in July then wouldn't it put them in a worse situation, as it would become all too obvious that all this flip - flop was just so that could earn more money.

One correction here: The PDs that a visa bulletin shows do not depend on how many are applying, it depends on how many pending applications are ready to be approved. The PD is set as the date of the first applicant that could not be approved due to non-availability of visa numbers. Technically, the PDs should no go back beyond the cutoff dates they had before the recent jump in June. It might be affected after a few months/years when all the BEC filers will be ready to be approved.

>> AC21 memo is a real memo.
Wow, what an ignorance. May I ask, what do you mean by "real memo".
Read previous post and get enlightened. I can't believe that you guys even don't have distinctions about law, CFR, and memos.
AC-21 is law.
Hope it helps.

Not a legal advice.
Correct. It is a bill that was signed into a law. Though USCIS follows AC21 in form of Memos, the law is binding and that's why we see that AC21 always works . It cannot be compared to the new h1b memo.

I am thankful to everyone who read or responded even if you don't agree. Taking it a step furthur there are couple of things that stand out which i think again show how we twist every fact to our advantage.
1) US need immigration to grow and prosper. wel agreed, but who are we to preach. Its for American to figure it out. We don't care for our mother land i:e India but we are first to point out how US will be worse off if it stops immigration. I really doubt the intention here. You know, we care more bout US then India and once we get our GC we probably wont care much bout US either.
>> You coward. This is a democracy and the constitution of US allows any one on the land of the United states to speak up and make their case with the US government. You dont need to be a citizen. You and your typical boot licking mentality. Not all of us are selfish maggots as you are and think only about ourselves. We do care about the US. Just dont think that every one is exactly like you in his/her attitude towards US. Preferences are different from caring. Just because one has chosen to immigrate to a different country does not mean that the person does not care for his/her motherland. By your logic, the laloo prasad', Gandhi's, Advani/Modi/Naidu etc all do care for India. LMAO. Will you please shut the f up? <<
2) Saying its a fight for rights and if we don't fight we are cowards. well i agree we are all cowards not because we are not fighting to bring forward all mighty priority dates but because we showed our backs to our own country. We went to public funded IIT and other institutions and then ran away from our nation at first chance. So yes, in a way we are all cowards here.
>> Ok Mr IIT, Stop generalizing again. There are people who paid different kinds of amounts as tuition fee to get a degree. Last time I checked IIT's accept a paltry 3000 students together. Definitely not 300,000. Again, just because you chose to immigrate does not mean that you have showed your back to your own country. If you consider so, please turn the back again and go home. This is a place for individuals who want to immigrate to the US. Not for scums who want to dilute and defeat the whole purpose. You are entitled to your opinions. If you want to take the masses back home, go do it on your turf. <<
3) USCIS should be fair to India. If you look closely, USCIS rules are not country specific. Quota applies to every country, but only India, Mexico and china exhaust theirs. Does tell u something doesn't it.
>> Thank you for showing your two feet in your mouth. Those are not USCIS rules Mr Ignorant. Those are the rules set by the US Congress as a part of the INA act. Your logic of speaking for country caps only shows that you have no idea of the head/tail of the country caps system. Lets apply the country caps on F1/H1B as well and take your sorry a$$ to where it came from <<
Finally, Thank you for your smart and intelligent attempt to dilute the members' focus. First you start off by saying that we have no allegiance to our home land and finally you deduce that country caps are OK.
Inference: You are some psycho who is concerned that the glass ceiling of country caps in employment based system will be shattered sooner or later.
