That is right. There are people knowingly get into dirty deals with employers like
(1) Faking experience
(2) Working out per diems in percentages
(3) Changing job titles to suit their needs
(4) Most important - employee tries to do what he/she can to keep employer happy as the green card petition is filed - I have seen this - people I know do this - they lick the boots of their employer - get coworkers fired so that their jobs are secure - get personal in alomost everything with employer so that they feel secure and job satisfied - These are the people who come out anonymously and talk bad bad things about their employer because they know they are into a screwed up relationship - no pay hikes, employer cheating on perdiems - employer knows employee is ass kissing and talks sweet but exploits - employee knows that things are not going to be the same for a prollonged period - puts a false mask and blames organizations like IV for not doing anything - these are the folks who encourage employers to do what they want to do.
And the day these employees get their green cards, they will open they companies and will do the same thing to the new immigrants; and the circus will go on.

I had a quick question to ask. My, current H-1 visa is expiring on July 30, 2008. Also, my current I-94 and I-797 is expirin on the same date. I am eleigible to apply for extension 6 months in advance, starting Jan. 30, 2008. However, my question is if I apply for my H-1 visa extension now (say Feb. 28, 2008) and the extension comes by April 30, 2008; will that invalidate my H-1 visa stamped till July 30, 2008.
Please refer me to any official memos if available. Thanks in advance.

Did you change employer when you ported from eb3 to eb2, or stayed with the same employer?
- 2004 filed for Labor and started EB3 process.
- Company got acquired in later years . Filed new I140 ( I think it is called successor-in-interest)
- Recently started fresh EB2 process for interfiling of EB3 to EB2 . GC approved.

This was because a few people wrote to them about IV and requested them to do a followup article abut us. I had found about 72 articles yesterday morning and we had more than 50 potential reporters to contact.It is not easy to get press coverage and this is one opportunity where we can captitalize on the venture captitalist story (no pun intentended).

How many core IV members have already received their GCs besides Aman, just curious?
Of late is there anything of note even happening on the lobbying front? IV seems to have become another Immigration Portal kinda website where people are now posting all sorts of info, some of it not even immigration related.
It would be nice if someone in the core team updated the rest of us, who cannot join the state chapters due to personal reasons on the website.

Regarding the 1st point, we, or at least I, am already trying to recruit as many people as I can, also posted IV posters in a few places.
Does anyone know how the illegals got word out about their rally across the country, or specifically press coverage about it? If so, we can try to use the same source, not for a rally, but to get IV's name out and talk about our major issues reduced to 2-3 points, so it is not confusing for the public.
Regarding, 2nd point, I think we can all contribute small amounts, say $50-100, but unfortunately most of us are stuck in low paying jobs. If we can get employers involved, that could be a better source of funds. Seriously, I dont expect many employers to contribute, but maybe academic employers who are losing funding because their H1-b employees are not authorized to get it, might be more willing to contribute.
Also, is anyone aware of any Indian American politicans, perhaps local Congressmen, that we can contact? I think I read recently of one in Texas.

I have written atleast 2-3 times to my senator on numerous occasions.
I feel, your words, combined with your thoughts about how this affects you helps a lot in conveying and putting the message across.
I just got sending a email message to my senator here, I am going to follow it up with a letter.
Email message reads like this:
Dear Senator Boxer
I have been a legal resident in state of " " for close to 5+/X years and I have been a legal resident in the USA for a total of X years.
I am a legal immigrant, whose application for permanent residency has been pending for the last 3 years.
The U.S. government makes only a certain number of immigrant visas (green cards) available each year and these are allocated among the various immigrant visa categories and countries from which applicants seek to emigrate.
Retrogression: For the past few years, the number of immigrants approved for employment-based immigrant visas has been lower than the number of visas available, resulting in no backlog in visa numbers. Recently, the DOS has seen far more immigrants approved for employment-based immigrant visas and has run out of visa numbers in certain categories, causing a temporary backlog or "retrogression" of visa numbers.
EB-3: This visa category includes employment-based immigrant visas for:
1) professionals with a bachelor's degree
2) skilled workers in positions requiring two or more years of experience or training
3) unskilled workers

Some visas are now going to be eaten up by the surge of 245(i)s from 2001. Irrespective of the the nationality of the 245(i) applicants, they are impacting every category witihn EB3. That is the main reason that almost all EB3 categories have retrogressed and will remain so for a while. Its a grim picture but thats the reality.
We need some intervention from Congress, otherwise people like me will have to wait for years - possibly half a decade or more
I support your opinion that there cannot be any amnesty for illegal immigrants, but there should be emergency relief for legal immigrants stuck in the logjam for years. We ought to make it a little fair for legal, honest and law-abiding legal immigrants.
Please support any bill that gives a temporary relief to legal immigrants (especially Employment based applicants). A temporary increase in the number of Visas allocated to the Employment based categories can substantially alievate some hardship.

Its not a case of inter filing where people are using other peoples priority date. Thats long gone. This is using ones own earlier I-140 priority date. Its not an easy process. It involves redoing everything. It involves time. It involves losing a lot of money. And we too have waited in the line. Some people are fortunate to apply in EB2 and some have to do it in EB3. Then as years go by they become eligible to apply in EB2.(When they are promoted to be manager, they are eligible to apply in EB2 quota) So that does not mean they now should go and stand behind the queue. So be kind. Everyone is in the queue. And I am working for a reputed company and not like what you have described. I was frustrated like you when USCIS did many things like opening up the queue for EB3 and recently EB2. People who applied for Green Cards after me have got it. Many even have become citizens.

Our PDs are close.Mine is jul-06 eb3/I. My family's all 485s had a soft LUD on 03/31/2009 and today 04/01/2009. I am thinking it could be because of 2nd finger print notices for our family.
