What happened in your case?
I rear-ended a car last April..The damage to the car (other person's car) was minimum (<1500) but the other driver claimed whiplash injury...They wanted 10K from my insurance (at that time that was my limit..:-( ).
But my insurance offered them $2500 and they rejected the offer and filed a lawsuit in the county court.
I have a deposition this month..God knows what will happen..
But I am curious to know what was your accident about.

Do you guys really think this bill will become a law that too in its current state and the added amendments? I seriously doubt it. If it is then dont you think the corporate business lobby that has fought really hard to increase the h1 b's to 115000 would have just sat mum while the H1 B fees were increased? I think this bill is just getting too absurd to become into law. I dont know but it would be interesting to hear what the businesses have to say with the increase in h1b fees.
May be I am totally wrong but just thought of posting this because I have been reading so many depressing posts from everyone. Have hope and faith. When the going gets tough, the tough gets going. At this point we need to strategise, which I am sure IV is doing it excellently. We may need to make a few compromises but try to make friends with others who are lobbying.
Please dont bombard me. Its just my thought. Please ignore this post if it offends you.
Guys,
Can we lobby to add an ammendum to pay huge penalities($50K) when all the current GC holders apply for Citizenships.

Folks,
This my copyright and very much pertain to our situation:
*********************
I left my world in search of prosperity
The prosperity is taking an eternity
My struggle is long and daunting
Making it more and more frustrating
Life at times seems uncontrollable
Flowing with the time unstoppable
Graying hairs testify for the feeling
Fat belly making me further unappealing
Sometimes I think of going back
Try to gather the courage that I lack
But the world I left is not the same any more.
And the world I am in, has lost its lure.
I am on the crossroad of my life
One is forward, one is left and other is right.
I don’t like the choices shown
May be I would have to create a world of my own
***************
Thanks

Sounds good.
Zooooom ?? Do you want to open the thread (please add the important points of the conversation going on this thread as your first message, so we can repeat that over and again for people who join later).
Zoooom & Anzerraja:
The core membership may be modest and may not want to speak out much on this issue. It becomes our prerogative to drive this.
Lets do this. Zooom do you mind opening a separate thread, "Reimburse past expenses to Aman & other IV Core members" or something like that. Please post a message asking people to "pledge" an amount towards that effort. Can you two drive this effort. I am also available for assistance.
We will update members who pledge how to finalize their pledge by any of the following methods based on subsequent expert advice:
1) Should they contribute to IV directly
2) Send a personal check to Aman.
3) Other method like IV reimbursing Aman and others from the common donation corpus.

not sure how to do this. can some one in this thread create a poll just for eb3-India just to see a ball park number of people waiting in eb3 india and for how long they are waiting (may be we can start from jan 2001 all the way till jun 2008). This atleast would give us an idea of how many IVers are waiting in eb3 queue..pls discard if you did not like this idea. thanks.

Firstly, I am not a lawyer and I would recommend that you get a lawyer to help out.
As mentioned before this is a civil lawsuit and not a crimial lawsuit. Impact on GC should not be a factor but consult an immigration lawyer.
Now depending on the state law you should not be liable for Cars2 through Cars7. It could easily be argued that they did not leave a safe distance between them and hence the ripple effect. What the insurance determines is the fault is not necessarily how the law would interpret it. So if you insurance of any of the car insurance assign percentages of fault, it is pretty much based on their calculations. Did you recieve a traffic citation? If so did it indicate that you were at fault for all the subsequent accidents? Did you contest the citation? If so what was the outcome. If you contested the citation and got the charges dropped you have a stronger case against each of the other plaintiffs.
Try to settle out of court and get the lawyers to drop the case. The way you do that is to claim that you don't have any money. Remember the lawyers for each of the plaintiffs have done an asset check on you and they know how much you have. Although the judge could request that each of the transactions to reverse. Do the following:
Read this post: http://immigrationvoice.org/forum/showthread.php?p=249649#post249649
1. Take out second mortage on the house (if you own it) and transfer cash to a relative's name in India
2. Sell cars and lease new cars
3. Cash savings etc should be transferred to relative's names in India.
Show the lawyers you don't have any money and they will not be able to recover their fees from this lawsuit. Do not capitualte to threats. Instead offer to settle out of court. Let them come up with the offer and then bargain like hell.
I hope this helps. If you need to talk more send me a private message.
just curious..y cant he put his money in his bank account in india..
do american law have control over indian banks or can they check his assets in india..do they have the power to do tht..
i thought they can only mess with hos assts inside USA

Guys,
How about start or finish the rally with US National Anthem ?
This will get a lot of attention. Above all it will show 'Legal Immigrants' different + communicate a lot.
Also encourage to get more American friends.
You can have a beer after the rally !
Good Luck.
This is a perfectly Gandhian idea:-) (He did that in South Africa)
Let's do it... the beer part should be postponed to some other time... presumably after all categories become C:-)

Probably most of you are aware of these things. So, let me say this advice is for newbies in the job. Lay-offs are done for business reasons and cost considerations. An American friend of mine lost his managerial job after 18 years of loyalty and experience. Company did not see the reason to continue to be in that business and the entire division related to the business was laid off. So working hard is good. Definitely a deserved trait. Do it for self-satisfaction, but not out of fear of loosing the job. At the same time, we should not be cloistered within the company working long hours. There are other things imprtant in life apart from the eight hours we spend at the office. I tend to my hobbies to keep my sanity after work. I look out for business indicators/news regarding how my company is doing. Good financial planning mandates savings around 6-12 months of living expenses which would lessen the impact of lay-off.;)
Yes I learnt this the hard way when I was fired from a fulltime job after working 4 years and contributing with a lot of hard work and dedication. I was fired in less than a minute and I was in 6th year of h1b. LOYALTY TO JOB MUST NOT BE FOR THE REASON THAT THEY HOLD YOUR VISA AND GREEN CARD. I moved out to consulting company and now work on %age and now I don't really care about being artificially loyal to any client. This is more healthy, resume gets built and you do not have to worry about losing your visa and status as long as you are in project, and as such changing projects is not difficult these days.
Most of the immigrants tend to be artificially inclined and have love and affection towards their companies just because Green card process is going on. Companies love to be cuddled by you but will not go out of their way for you.
The very reason logiclife and other folks started this group is because we are on our own. It is a fact that we are at no advantage with retrogression. Offcourse there are choices and one always has choices. Keeping quiet and accepting crap is not right. Whether we succeed or not, we must not accept crap as "fact of life". There is a saying "If you can walk, you can work".
I also agree that "working long hours + artificial loyalty" on h1b just for a GC is not proper reasoning for this cause. The actual reason behind this cause is a broken system that definitely needs too be fixed.

Newer version is - as should've been expected - more protectionist than before.
1) It prohibits H1B workers from working in contract positions. There is a redundant provision for the L1 visa as well (there is already a law which does this for L1). However it doesn't prevent American companies from keeping these contract workers in India or elsewhere and co-ordinate the work through web-conferencing, video conferencing, VPN/VNC etc.
The day this law passes will be a great day for Outsourcing, and a sad day for America.
Which part of the text got you to this summary? Am I missing something? I don't see H1B ban for contract positions anywhere.. Pls. clarify.. Thanks for your analysis..

Still Indian IT depends on US market.
Not for very long. There are bigger, faster markets than US in the world.
No country come to the level of US yet in technology.
A joke, right? Financially maybe, technologically never. Most European countries are far more technologically advanced than US. I'm sure Japan, Hong Kong, Singapore also are all more advanced than US.
For example, only US is still using paper checks to transfer money. Using coins to pay for a phone call in phone booth. Still has no control over who lives in the country, or who goes in and out. Still not using computers for processing immigration applications (Why do I have to send in the same papers 10 times, send in tax papers, give my background info, give fingerprint 10 times.... and this all on paper... come on it is 2007 not 1907). Still drive around in cars instead of having a good inter-city connectivity with trains. No high speed trains. Still likes to see rubber stamps on official papers and believes it has any kind of value.
And so on and on and on.... I could write a book why US is behind most civilized countries. But thats ok. US is what it is.
But the worrying part is; it is going to get even worse when they kick out all the H1B etc who are here legally and provide free knowledge. And instead keeping the uneducated mass of Mexicans or south americans who run across the border illegally and then given amnesty by some fool in Congress. Good luck with that project.
Not a country I want to live in or pay tax in.

you should get it soon. Call the service center where your case is to check further as online status is not a good indicator. In my case per TSC i was approved on 9/4 but my online status did not change until 9/11.

You seems an expert in this option trading. How about microcap stock trading ?
I am not a chartist or day trader if that is what you want to know. I have worked in high frequency Stat-Arb trading which also does micro caps sometimes.
