Good job in starting this thread. I got frustrated like this a few months ago for the same reasons that you & the other members have mentioned here; it definitely resonates with mine. So, recently I have decided to move to Australia by applying for a PR and plan to be there for a few years before eventually moving back home.
This is what I'm doing right now:
[1] Working on my PMP cert. [2] Will be starting a business outfit in Chennai shortly, by the end of this year.

Yes, we are not a third world country. Thats why we still see people like Harshad Mehta and Abdul karim Telgi. Both stock market and stamp paper, backbone of indian economy could be easily exploited by two individuals.
We are still manipulating the stock market. From 3000 to 21,000. Every sadhus, saint, soothsayers, magician, poojari's, astrologers predicting sensex to touch 35,000 by this year end. Even one guy predicted, 50,000 points in 2010.
I am just telling the fact. Look at TOI and other online newpapers economic section. Read the past year news.
Side note: stable oil(price) is the backbone of world economy. We know who manipulates this oil market and who gains out of it? Is it not a few corporations? But tell me honestly how many countries are affected by this inflated oil price.

Did it occur to anyone that we are only talking about compensating Aman the $64k he spent already. Imagine if he had made use of that $64k as an investment(let us say a safe investment with minimum returns) of that amount it should have exceeded that $64k value by now.
The least we can do at this moment is to immediately refund Aman and other core team members the amount they have spent towards the administrative costs of IV. Pappu / Logic Life / Other core team members, please let us know what kind of legal/administrative action is required to get this done.
We will immediately start a funding drive towards filling in this shortage from the total IV funds. IMHO on the longer run the smaller funds ($10, $20 etc) should not be neglected.
Let us figure out the required amount and have a new thread started about this. This settlement should be treated with high priority before any other funding drive. Pledging my $200 towards this.

Not a single penny has been reimbursed to him for his trips to DC, food and stay in DC or car rental in DC. He even risked his job and went to DC on unpaid leave at critical times because lobbying was important for getting our work done. We in the core team know this and when we see the kind of contributions we get from members, we feel disappointed that our efforts are not valued. When we started the $20 contributions people felt $20 was too high and wanted $10 per month or less. The kind of work and effort that is needed to push a single provision is phenomenal and needs lot of capital. The more the better. Sometimes reading posts that say IV core is selfish also disappoints us. People do not know the effort that goes in getting anything done. This website is simply a tool for us to communicate to everyone. The big effort is the lobbying work. Ok. I agree with everything you say but you still haven't explained why EB-2 China hasn't moved. They never were Unavailable, which means they haven't used their quota but are still retrogressed. Why absolutely no relief for them? Not even a month forward movement?
To be honest, I have no way to know why absolutely no change for China. There have been times earlier where India and China had similar cut out dates, then they changed dramatically, then India became unavailable, and now they are same again. With so much happening, I would say its very difficuilt to have a logical reason with no real data.
All I can come up is that perhaps China might had a little higher demand than India in the last few months, or just that in case of spill overs, most visas might be consumed by countries most retrogressed, or perhaps DHS believes that the number of visas spill over would be only enough to cover EB2 Inida + EB2 china up to a certain date and China was already at that date, so if the demand is less than expected, then we will see movement in both India and China.
Wish best for all Employment based filers. Hopefully some law change comes and justice is done to every one.
I would hate to see different immigrant groups worrying about which group is getting ahead.
Keep contributing to IV effort and hope no one need to go through extended wait times..........

I agree with the initial post . But the market condition is such that it is very difficult to get qualified people for ERP/CRM applications so desi consultants get placed through desi companies .

I totally agree everbody. ICICI bank all time sucks. I have account with them for 5 yrs. and everytime I do transfer money to India (FYI I do Wire Trasnfer On Monday morning US CST only should be credited in 1 business day, expected that the money will be credited by Tuesday IST ICICI Business time). What happens eveytime they will credit after 5 business days and provided with lowest Exchange rate. I had big fight with poor customer service people.
One time funny thing happend. I did wire transfer money from my local back to New york bank (ICICI) . My local bank confirmed in an hour that the money got credited in NY bank. I thought money was credited to my local ICICI bank back India in 1 day. Now fun started I was counting the days 1,2,3,4,5, etc... nothing happend. God know what happend to money. I called CSR... I explained her "money transferred to NY bank a week ago." still not credited to ICICI bank. She was telling me that, I should transfer money again then they will deposit the money. I was totally pissed off for their answer. I said, her money already debited from my local bank and money is sittling in NY Bank(account of ICICI). After 1 1/2 hr on the phone she repeatedly tells me that deposit the money again... I hang up the phone, and wrote a big letter to ICICI Mumbai. Then then deposited me the money. Finally claiming that the money was not showing in NY bank that is the reason they were unable to credit in ICICI NRI Bank.

I won't like to take names on public forum of the Congress members we have/will approach. But to answer you question, we are taking all necessary steps to make this walk a success. Also, the measure of success will be a large turn-out by legals to protest, which in itself is unprecedented. We won't like to marry the success of this protest with the presence of any particular Congress member or Senator at this time. The bottomline is, media coverage for our issue.

and there are many professionals stuggle to get an h1b visas even after engineering degrees. In your case, IGNOU is a shame. Its worse than University of Pheonix. Pheonix is one of the best available uni for long distance learning.
If you get a greencard in EB2, it will be a biggest mockery of the USCIS and department of labor.
Dont know what do you mean, as long as application is legal, confirming to law, it is as good as any other EB2 application.
Please dont pass judgements and refrain from spreading wrong information as factual statments. only suggestions should be welcome.

Given the current economic climate, I had a question on:
What happens to the wife (dependent's) EAD, when the main person:
- loses his H1 status but has an EAD and is working on it
- loses his EAD status because of I-140 withdrawal
- is on EAD and is unemployed for some period of time
In each of these cases, if the wife is working on EAD, should the wife stop working on her EAD ?

Sorry to hear your accident case.
Folks here have already given best suited solutions.
These days law suits after car accidents are increasing, I have heard of so many in last 2 years or so, so it nots something alien to justice system, attorney, or insurance provider.
In most cases that I have heard the amount is between $500k-1M, the good thing is that in your case amount is humongous, that could the most appealing reason for denial itself (remember DC Laundry case for $54M).
For worst case scenario, start trasnfering money to India (western union - cash) in smaller chunk, so you will be left the minimal to run your daily life (one of my friend did so while dealing with IRS tax fraud by desi consulting company). Good that you don't have any asset, they can't ask for asset in India, if you have not used that asset for US-tax, might be better not to mention from yourside. So if you loose the case you can show you have no money to pay (even outside the court) and can legaly leave US and go to any other country Singapore/Australia etc or back home... endless possibilities.

I will call the senators immigration liaison tomorrow. Hopefully she will not tell me that they cannot do anything besides what they have done because that is what they told me in September last year when I got a standard response last year.
Unfortunately nobody understands the pain and agony we are going through. For them, its just another day at the office, they couldnt care less. Nevertheless, I am going to try tomorrow.....hey, cant give up that easy.
I will call CS again tomorrow, I dont mind being yelled at and I am gonna tell her this time that I have not opened a SR. Atleast, she will then transfer my call to a IO.
Let's see what tomorrow has in store for me!!

Guys,
Please refrain from fighting on EB3 and EB2 issue. We all know how difficult retrogression has been to every one here. As some one has already said, If interfiling was so easy and every one was fortunate enough to file another Labor/140, EB-2 would have been in 2002 or along with EB-3. AFAIK, Interfiling is some thing the law allows and as long as one does what the system allows and is not gaming the system, its perfectly fine. Don't rub salt on others wounds. Do what you can to improve the system. IMO, the backward movement was a knee jerk reaction to the false demand, shown by USCIS with a huge movement in PD. As you may know, this is purely demand and supply based DOS will move dates forward as soon as they realize that there is not much demand. DOS keeps track of all visa number requests and approvals based on PD's. The problem is DOS just does not know how many applications are pending per country per category to stop the back and forth movement of dates and make the date movement strictly forward. Please refrain from fighting on EB3 and EB2 issue. We all know how difficult retrogression has been to every one here. As some one has already said, If interfiling was so easy and every one was fortunate enough to file another Labor/140, EB-2 would have been in 2002 or along with EB-3. AFAIK, Interfiling is some thing the law allows and as long as one does what the system allows and is not gaming the system, its perfectly fine. Don't rub salt on others wounds. Do what you can to improve the system. IMO, the backward movement was a knee jerk reaction to the false demand, shown by USCIS with a huge movement in PD. As you may know, this is purely demand and supply based DOS will move dates forward as soon as they realize that there is not much demand. DOS keeps track of all visa number requests and approvals based on PD's. The problem is DOS just does not know how many applications are pending per country per category to stop the back and forth movement of dates and make the date movement strictly forward. Its not a case of inter filing where people are using other peoples priority date. Thats long gone. This is using ones own earlier I-140 priority date. Its not an easy process. It involves redoing everything. It involves time. It involves losing a lot of money. And we too have waited in the line. Some people are fortunate to apply in EB2 and some have to do it in EB3. Then as years go by they become eligible to apply in EB2.(When they are promoted to be manager, they are eligible to apply in EB2 quota) So that does not mean they now should go and stand behind the queue. So be kind. Everyone is in the queue. And I am working for a reputed company and not like what you have described. I was frustrated like you when USCIS did many things like opening up the queue for EB3 and recently EB2. People who applied for Green Cards after me have got it. Many even have become citizens.

thanks for explaining. my suggestion then is to go to school on F1 (maybe ?) and get a degree that can help him/her get a job that qualifies under H1b.

Well then by that logic the US Govt can turn around and tell all of us the same thing right? This is our processing time, take it or go elsewhere :)
Also converting to an f1 has SERIOUS implications. For starters you have to shell out a LOT of money for a full time degree. Secondly in some cases the person may STILL not be eligible to apply for an H1 coz that job profile.
Lastly I did not mean we contact Human rights activists for the same.

Yesterday, I got RFE for myself and my husband and need to respond by April 29th.
On my husband's 485 application we entered Last Entry Date wrong, they asked for the proof for the same and all I-797 issued to him so far. We have all his I-797 approvals and he was never out of status, but just worried that we put wrong date for Last entry Date.
I have sent the RFE to my attorney, waiting to hear his response. I am really worried what it could mean, not sure if it is a big thing or a simple RFE, need your advice.
For myself they have asked for I-797 approvals to show valid employment authorizations with the company from April 2004 - Deceber 2006.
I also have another question, my husband is on EAD since last year. Our 6 years on H1 are expiring in June 2009. Can he get H1 for the period he was on EAD?
Please advice.
