visves, Longq, alisa...
We have a difference of opinion on how the law is interpreted....
I believe that visves interpretation is correct....But there is always a small chance that longq does followup with a lawsuit, USCIS would budge...
if longq wants to gather some EB2 India/China and have a crack at suing USCIS as a personal level....( i.e.not using IV's resources).....I guess no one can stop him...I am EB3/India....So that suing does not benefit me anyway...
The common denominator for all of us is increasing the total numbers......
If members want to pursue certain things on their own at personal level..I cannot do anything ...after all it is a free country...

Deadline = April 30th, 2011
Goal = 5000 votes on survey in I-485 filing w/o current PD thread (http://immigrationvoice.org/forum/forum14-members-forum/1599353-want-to-file-485-when-pd-is-not-current-gather-here.html). Based on response by 04/30/2011 - IV will decide whether to even proceed with initiative or not.
Actions - 1) Vote on survey. 2)Email ivcoordinator@gmail.com with PD, ph#,email & subject "I485 filing impacted, 3)Print/Circulate Fliers and spread FB, wiki link (see "support thread (http://immigrationvoice.org/forum/forum70-self-filing-documents-forms-directions-mailing/1845295-support-thread-for-i485-filing-w-o-curr-pd-initiative.html#post2243885)" for more details)
Dear IV Members,
If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

Contribute to Advocacy Event on the Capitol Hill (http://immigrationvoice.org/index.php?option=com_content&task=view&id=26&Itemid=44#onetimepaypal) (All one-time contributions will go towards organizing the Advocacy Days event)

Thanks for all the replies! I already contribute to IV, so all the mails about contributing to IV can stop :) You dont need to sell me IV.
I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.
Folks
Keep the jokes aside, this is not another thread which come up every now and then ( as i thought initially).
This is really serious question or looking for serious opinion.
Aristotle : if you have doubt that your earlier 140 will be canceled, once you move to new job , then consider waiting ( till 02/15 atleast)

There are more than just national anecdotes, however. Everyday Americans are affected. Since looking into the H-1B visa program, some of my constituents have come to me and spoken out against abuses they see.
Another constituent sent me a letter saying that he saw firsthand how foreign workers were brought in while Iowans with similar qualifications were let go. He tells me he is a computer professional with over 20 years experience. He was laid off and has yet to find a job. He states: I believe [my employer] has a history of hiring H-1B computer personnel at the expense of qualified American citizens.
I received a letter from a man in Arizona who works for a company that employs dozens of H-1B workers. When he asked his supervisor why so many foreign nationals were being hired, the head of human resources said: If the company has an American and a person from India, both with the same skill set, the company will hire the person from India because they can pay them less. These are firsthand stories from U.S. workers.
I ask those begging for an increase in foreign workers to explain these cases to me. Why are Americans struggling to get jobs as software developers, data processors, and program analysts?
From How Safe Is Your Job? (http://www.parade.com/articles/editions/2007/edition_07-01-2007/Intelligence_Report) By Lyric Wallwork Winik | parade, July 1, 2007
You could lose your job to a foreign workernot because hes cheaper but because he has better workplace skills and discipline. Thats the message Labor Secretary Elaine Chao hears from U.S. executives who are worried about Americas competitive future.
Beyond the cheaper cost of labor, U.S. employers say that many workers abroad simply have a better attitude toward work. American employees must be punctual, dress appropriately and have good personal hygiene, says Chao. They need anger-management and conflict-resolution skills, and they have to be able to accept direction. Too many young people bristle when a supervisor asks them to do something.
As for our job future, Chao notes that most of the fastest-growing jobs today are in industries requiring advanced knowledge and skills and are very high or high wage.

Dear Core team,
Thanks for your efforts and initiative. Those who or not part of Core team has no right to question thier ability, or asking for updates every hour. This is purely a volunteer organisation founded and managed by Core team.
PAPPU and logicfile have every valid point. How many of us are really trying to help either work or financially? However we visit the site 10 times a day.
Well I request the CORE to kindly ignore and try to achieve our goals. No doubt in this aspect you are the leaders who took initiative. we try to follow and support our best.
Please ignore the people "who knows not and knows not that they knows not". Shun them.

Thats not entirely correct. Three of the most vocal supporters of us are
Sen. Brownback(R) - Kansas
Sen. Hagel(R) - Nebraska
Sen Coryn(R) - Texas
They are from the so-called conservative states.
I haven't heard anything positive for our cause from senators from the so-called sophisticated/liberal states like Illinois (Dick Durnbin & Obama) , NY , MH (Kennedy and Kerry), CA (Boxer and Fienstein) for our cause. In fact they have gone towards family immigration and are screwing us in the process.
If you might notice that all these Senators who are coming up with these brilliant ideas are either from some god forsaken place in the US where there is nothing except a WalMart and a Church or the Senator doesnt know his economics right and is using VOTE BANK POLITICS parallel that to the recent Mayawati being elected in UP & AB & AMbani getting hit in scams and SEZs.

Thats exactly why we need to be against L1s. There is no numerical limit on them. Companies can pay peanuts as you just wrote. They work here for 1 year and take the job permenantly. They screw the work culture here
What work culture you are talking about.. LOL!!
Its besiness man... you are in a captlist country...
And we are here because of GLOBALIZATION...
Don't be too selfish

It may not look as bad but this is a time to step back and take a better look on every step moving forward. This is a very testing time for the economic outcome in the next few months. A very sad episode to have come upon an Indian family my heartfelt condolence to them.

WASHINGTON: Multiple gunshots echoed in the upscale home of an Indian family in a quiet, gated, suburban Los Angeles community last weekend, echoing the troubled times in America.
When police turned up on Monday morning after calls from a concerned neighbor waiting for a carpool ride, they found the body of 45-year old Karthik Rajaram, an unemployed financial adviser, lying in one room with a handgun he had used to shoot himself dead.
With him lay his two youngest sons Arjuna (7) and Ganesha (12), both shot dead. In different rooms across the house they found the bodies of Karthik’s wife Subasri (39), his mother-in-law Indra Ramasesham (69), and his eldest son Krishna (19). They all appeared to have been shot to death by Karthik Rajaram.
Police also found two suicide notes – one for the cops and one for extended family and friends -- and a will. In them, Rajaram he spoke of his financial difficulties and took responsibility for killing his family members, police said.

I know a lot of people using pre approved labor certs waiting for GC. What happens to them? I think this rule will affect only those who are trying to do Labor substitution in future.
----
i could be wrong, but if i remember correctly, when this ruling was published last year, if a pending 140 was filed on labor subst that would get rejected.
An approved 140 with labor subst was ok.
Please correct me if i am wrong.

I agree with most of your comments here. I am more realistic than most people here in the forums. So, I dont want all ducks in a row and world peace issues sorted out. Because, I know that is not happening anytime soon.
True, in a election year and with all the anti-immigration sentiments around, it is highly unlikely that something will happen in the near future. So, NO. I am not waiting to see some success, before I join the band wagon. When you started IV a few years back, I am not sure you envisioned this many members today. Inspite of having over 25000 members, the admin fix compaign only seem to have received about 10% letters. So, What are the other members doing? Why are they not participating? what is holding them back? That is a question for everyone of us. That is something, I thought every member should reflect upon. We have around 25000 members here in IV. But, we know for a fact that there are atleast a million people waiting in line. How do we reach them and how to get them to actively participate in IV action items?
Like you said, IV is a grass roots organization and it is up to the members to make things happen. But how? Apart from these action items for admin fixes etc, Can't IV have a membership drive? Get more people to join IV and contribute.
I know for a fact, that there are so many people here in Nebraska who have no clue about IV. I have been educating them when I get an opportunity. A Local Chapter could easily solve the problem. But, until now, I had no clue as to what is required to start a chapter. (Thank you Walking_dude). Answers to questions like this is what I meant by transaparency. Not the accounts or donations, as someone suggested in this forum.
Also, When I suggested about honarary payments to core team, I am not trying to belitte anyone in the team. I just thought, that you and other members of the core team should be compensated for all the efforts you put in. After all, these efforts and money you spend is going to benefit me and every other aspiring immigrant of this country. So, It was just a thought.
I will try my best to lay the foundations of IV presence here in NE. I would welcome any suggestions and comments.
It takes time. We all started out like you, in the Tri State Area, and in other cities we targetted grocery shops, distrubuted flyers in major events, had booths and out members tirelessly and selflessly worked and continue to do so. We see more and more members getting motivated as time goes and this is a good sign.
We have started off a lot of publicity campaigns like advertising on local radio, different sites, mailing lists, emails, invite a friend, free legal counsels, meet and greets and it just goes on.......
You are most welcome to take initiative and execute it and IV members will provide you all support u need.
Evey IV member can support IV in some form or the other.
I am personally glad that you are now motivated. Welcome to the band wagon.
