Of course he is very informative, however he is very biased and having wrong openion that EB3 India has stolen EB3_ROW number in previous years as he belongs to ROW. He wrongly assumes that till EB3-ROW becomes current EB2 & EB3-India will not see any movement. He thinks no one knows the rules, laws ect..and he is only one knows everything. The actual fact is most peoples have been doing research on retrogression like him last two years and not having enough time to reply his post. To fuel his openion DOS is violating the section 202 of INA and no one cares about this including IV core team.

You should consider gathering a few more EB2 India guys and have a crack at suing USCIS for violating the law...Unfortunately I am EB3 India and this suing does not help me...
You can ask for GCs for all members of your law suits...But USCIS would fight you hard for sure...
IV is collective organization...IV's solution would be to get numbers increased for everyone...Otherwise we would again have a fight bet EB2 and EB3 link the one we had between guys who want the 485 without PD and those who oppose it...

First and foremost, a Big THANK YOU to all the IV core team who along side their full time jobs were working behind the scenes in getting this done and having to go through the hecklers and naysayers.
A big thank you to Congresswoman Zoe Lofgren in helping pass all the pain and outrage of legal immigrants to the people incharge and making them listen.
Also last but not the least, every active member of IV who participated in the flower campaign, in San Jose rally and in actively informing media on IV projects to showcase legal immigration issues. And for keeping saner heads in the insane times.

Dear friends, as I read all of your stories, I cannot help but relate it to mine. Even as I write this though, I am in the middle of a dilemma - I am being offered a promotion to a Director position and I cannot decide whether to accept it or not.
I have been in the US for over eight years on an H1 and have been working for a Fortune 20 firm as a Manager for the last four. My company applied for my Labor Cert back in Dec 2002 and while it cleared State in May 2003, the application was stuck in Federal processing for more than a year. Just as it seemed like they were getting to applications that had been transferred in during May 2003, the BEC took over and I literally felt like the rug had been pulled from under my feet! It's been almost two years since then, but I have seen no progress at all - zero, nada, zilch!
Meanwhile, I have been working hard at my company sorting my way through leadership changes, reorgs and changes in vision and strategy. While all of my colleagues and friends were applying to new positions and getting promoted, I lay low. Four years in the same job - I can tell you that is a looooong time! It isn't just that work starts to become a drag but also life itself seems to be in limbo and the frustration of the wait starts to spill over into personal life.
I got married two years ago and my wife, bless her heart, has been making a valiant effort to keep busy and pursue other interests, since she is on H-4. However, I know she can't wait to start working.
As all of you know, it takes a lot to succeed in the US economy and be recognized, but I have worked hard. Not only have I paid taxes for 8 years, but I also feel like I have paid my dues. I have an MBA from a top b-school and skills that are in demand. I cannot help but wonder, whether we are meant to waste our lives away?? You start feeling like a second-class human. I know I can always go back to my home country but I have invested a lot of my life here. We need justice!

What is even more frustrating is that we are chasing this so called American Dream during the most potent years of our lives and literally wasting our lives away.
That's exactly it Ragz. That one statement summarized it all. The MOST potent and important years of our lives and our spouses lives are going Right down the drain. I feel even worse for the spouses. Atleast we HAVE jobs and our careers are going SOMEWHERE. The countless spouses on here and even more so not on here are suffering away today for a better tomorrow. It may just happen that when the Work permits/ GCs do come thru, our spouses' skills may be extinct due to having no work for so many months/years.
This is definitely an angle to explore. As my spouse was telling me the other day. God Forbid, if this problem lasts for another year and then some of us decide to move back coz we are tired of this nonsense, our spouses will find it just as hard to find jobs in our home countries as well. Think about it, our home countries are pumping out fresh blood everyday. Will the companies select them, or someone who has been out of touch with the job scene for 1-2 (or many more) years?

You are right.....even if EB2 PD becomes current and it takes 3 years for TSC dates to move forward to our ND dates....we are not going to have approval before then. So my earlier logic that being current on the basis of PD is meaningless unless you have ND which is current.
You rightly said that there are thousands of applicants with ND prior to you and they will be handled prior to your case............unfortunate but that is true.....and ofcourse preadjudication is a myth as usual...

The only way to enlighten yourself and others is to get yourself and your friends involved and participating towards the effort. You will automatically see the sacrifices made by others who are not thinking about "I" all the time.

Let us say that i agree to what ever you say. In what way does everything you stated above make a STEM graduate eligible for GC without an Employer sponsership. Why does it have to be only STEM graduates which will not need employer sponsership. If giving GC based on completion of MS in us is bypassing the employee sponserhsip then that has to be extended to all EB categories of immigrants (EB1/EB2/EB3) and the benefit o those visas have to be passed to the badly retrogressed category first.
It si not teh question of liek or unliking or having jealousy. It is the question of law. According to the US law employee sponsership is EB category so any new bill which has to be introduced will have to follow the EB category employee sponsership rule, othwer wise it wil not see the light of the day
Personally i see no chance of this DV lottery STEM billpassing in any shape or form either now or in the future
